These Terms of Service ("Terms") govern your access to and use of Domara ("we," "our," or "us"), including our website at domara.rent and all related services, tools, and applications (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
To use Domara, you must create an account with accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old and have the legal authority to enter into these Terms. If you create an account on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
Domara is an AI-powered property management platform for independent landlords and their tenants. The Service includes, but is not limited to: property and unit management, AI-assisted lease drafting, electronic signature collection, rent collection via ACH and credit/debit card, bookkeeping and expense tracking, AI receipt categorization, maintenance request tracking, listing page creation, document storage, and in-app messaging.
Domara offers a 7-day free trial with full access to all features. No credit card is required to start a trial. After the trial period, your account will be placed in read-only mode until you subscribe.
Paid subscriptions are available on annual ($10/month, billed as $120/year) and monthly ($19/month) plans. All subscribers receive access to the complete feature set with no tiers or feature gates. Subscription fees are non-refundable except as described in our 30-Day Money-Back Guarantee.
We reserve the right to change subscription pricing with 30 days' notice. Price changes will not affect active subscription periods that have already been paid.
If you are not satisfied with Domara for any reason within 30 days of your first paid subscription, you may request a full refund by contacting us at hello@domara.rent. Refunds will be processed within 10 business days to the original payment method. This guarantee applies to the first subscription period only.
Rent payments processed through Domara incur transaction fees paid by the renter (not the landlord): $1.00 per ACH (bank transfer) payment, or 3.5% per credit/debit card payment. These fees are subject to change with notice.
Domara uses artificial intelligence to assist with lease drafting, receipt categorization, listing descriptions, and other features. AI-generated content is provided solely as a convenience tool and does not constitute legal, financial, tax, or professional advice of any kind.
Important disclaimer regarding AI-drafted leases: Domara is not a law firm, licensed attorney, or legal service provider. AI-generated leases are templates produced by machine learning models and may contain errors, omissions, outdated provisions, or clauses that are unenforceable or non-compliant with your local, state, or federal laws. Lease laws vary significantly by jurisdiction and change frequently. An AI model cannot guarantee compliance with the specific legal requirements of your jurisdiction.
You are solely and entirely responsible for reviewing, verifying, and approving all AI-generated lease content before execution. We strongly recommend that you have every AI-generated lease reviewed by a qualified real estate attorney licensed in your jurisdiction before use, particularly for your first lease. You acknowledge that Domara bears no responsibility for the legal adequacy, enforceability, or compliance of any AI-generated lease or document.
BY USING DOMARA'S AI LEASE DRAFTING FEATURE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: (A) AI-GENERATED LEASES ARE STARTING POINTS, NOT FINISHED LEGAL DOCUMENTS; (B) DOMARA MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE LEGAL SUFFICIENCY, ACCURACY, OR ENFORCEABILITY OF ANY AI-GENERATED CONTENT; (C) YOU ASSUME ALL RISK AND LIABILITY ARISING FROM YOUR USE OF AI-GENERATED LEASES; AND (D) DOMARA SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, DISPUTES, OR LEGAL CONSEQUENCES ARISING FROM YOUR RELIANCE ON AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO LEASE DISPUTES, EVICTION PROCEEDINGS, REGULATORY PENALTIES, OR TENANT CLAIMS.
Domara uses artificial intelligence to generate rent estimates, property descriptions, applicant summaries, and other content. These outputs are provided for informational purposes only and should not be relied upon as professional advice. Rent estimates incorporate publicly available government data (HUD Fair Market Rents) and AI analysis but do not constitute a professional appraisal. You are responsible for verifying all AI-generated content and making your own pricing, leasing, and management decisions. Domara makes no warranty regarding the accuracy, completeness, or suitability of AI-generated content for any particular purpose.
Domara's e-signature feature is designed to comply with the ESIGN Act and UETA. Electronic signatures collected through Domara are legally binding in the United States for residential lease agreements. By using the e-signature feature, you and your signers consent to conduct transactions electronically. You are responsible for ensuring that e-signatures are appropriate for your specific documents and jurisdiction.
You retain ownership of all data and content you upload to Domara, including property information, lease documents, financial records, and tenant communications. We do not claim ownership of your content.
You grant Domara a limited license to store, process, and display your content as necessary to provide the Service. We will not sell your data to third parties or use your content for purposes unrelated to providing the Service.
You agree not to: (a) use the Service for any illegal purpose or in violation of fair housing laws; (b) upload malicious content, viruses, or harmful code; (c) attempt to gain unauthorized access to other users' accounts or data; (d) use the Service to harass, discriminate against, or threaten any person; (e) resell, sublicense, or redistribute the Service without our written permission; (f) use automated tools to scrape or extract data from the Service.
You may cancel your subscription at any time from your account settings. Upon cancellation, your account will remain active through the end of the current billing period, then revert to read-only mode. In read-only mode, you can view all your data but cannot create new records or take actions.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees. We will provide notice before termination when feasible. Upon termination, you may request an export of your data within 30 days.
Payment processing for subscriptions is handled by Stripe. Rent collection payments are processed through Stripe (card payments) and Dwolla (ACH payments). By using payment features, you agree to the respective payment processor's terms of service. Domara is not responsible for payment processing errors, bank holds, or delays caused by third-party payment processors.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMARA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO DOMARA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DOMARA DOES NOT PROVIDE LEGAL, FINANCIAL, OR TAX ADVICE.
You agree to indemnify and hold harmless Domara, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights, including fair housing laws.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Austin, Texas, administered by the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You agree to waive any right to a jury trial or to participate in a class action.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you may cancel your subscription.
